OVERVIEW
These Terms of Service ("Terms") govern your access to and use of the Render-Lab website, storefront, checkout, products, content, and related services (collectively, the "Services").
Throughout these Terms, "Render-Lab," "we," "us," and "our" refer to Render-Lab.
By accessing the Services or placing an order, you agree to these Terms and to the policies made available through our storefront or checkout, including our Privacy Policy, Refund & Return Policy, and Shipping Policy.
If you do not agree to these Terms, do not use the Services or place an order.
1. ELIGIBILITY AND ACCOUNT INFORMATION
You must be legally capable of entering into a binding agreement in your jurisdiction to make a purchase.
You agree to provide accurate, current, and complete information when using the Services or placing an order, including billing, payment, contact, and shipping information.
If you create or use an account, you are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
2. PRODUCTS AND PRODUCT PRESENTATION
Render-Lab sells visual artwork and related products that may include metal wall art, canvas prints, posters, apparel, limited releases, and other merchandise.
We make reasonable efforts to display products accurately. However, screen settings, device characteristics, lighting, photography, mockups, and digital previews can cause perceived differences in color, brightness, contrast, texture, or scale.
Room scenes, lifestyle images, and product mockups are illustrative presentations unless expressly stated otherwise. Product dimensions shown in the product listing or selected variant control over apparent scale in a mockup.
We may modify, discontinue, limit, or update products, product descriptions, availability, or specifications at any time.
3. MADE-TO-ORDER PRODUCTS
Many Render-Lab products are manufactured after an order is placed according to the selected artwork, material, size, or other product options.
You are responsible for reviewing all selected options before submitting your order.
Because production may begin quickly, cancellation or modification requests are not guaranteed after an order has been submitted. Our Refund & Return Policy governs cancellations, defects, damages, incorrect items, and refund eligibility.
4. ORDERS AND ACCEPTANCE
Submitting an order is an offer to purchase. Receipt of an automated order confirmation does not prevent us from canceling an order when reasonably necessary, including because of pricing or listing errors, suspected fraud, payment failure, product unavailability, production limitations, legal restrictions, or circumstances that make fulfillment impracticable.
If we cancel an order after payment has been collected and no substitute resolution is accepted, we will refund the applicable amount.
We may limit quantities or refuse orders where reasonably necessary to protect the Services, comply with law, prevent fraud or abuse, or address production or availability constraints.
5. PRICING, PAYMENTS, TAXES, AND PROMOTIONS
Prices are shown in the currency presented at checkout and may change without notice before an order is placed.
The price applicable to an accepted order is the price shown at checkout when the order is submitted, subject to correction of obvious errors as permitted by law.
Shipping, taxes, duties, and other charges are shown or calculated as applicable during checkout.
Discounts, promotional codes, and special offers may be subject to separate conditions, expiration dates, product exclusions, minimum-order requirements, or usage limits.
6. SHIPPING AND DELIVERY
Orders are subject to our Shipping Policy.
Production time and shipping time are separate. Delivery dates are estimates unless we expressly state otherwise.
Render-Lab is not responsible for delays caused by carriers, weather, customs, incorrect customer information, production disruptions, or other events outside our reasonable control, but we will work with customers and our production or delivery partners to address qualifying lost, damaged, defective, or incorrect orders in accordance with our policies.
7. RETURNS, REPLACEMENTS, AND REFUNDS
Returns, replacements, refunds, damage claims, and quality claims are governed by our Refund & Return Policy.
Because many products are made to order, they are generally not eligible for return or exchange solely because of change of mind, buyer preference, or an incorrect product option selected by the customer.
Nothing in these Terms limits rights that cannot legally be waived.
8. CANCELLATIONS AND ORDER CHANGES
Requests to cancel or modify an order must be made as soon as possible.
A cancellation, address change, artwork change, size change, material change, or other modification is only possible while the order is still eligible to be changed within the production workflow.
Once production begins, changes or cancellations may not be possible.
9. INTELLECTUAL PROPERTY
Unless otherwise stated, the Render-Lab website, branding, layouts, product presentation, original artwork, graphics, text, photographs, videos, and other original content made available through the Services are owned by or licensed to Render-Lab and are protected by applicable intellectual-property laws.
Purchasing a physical or digital product does not transfer copyright or other intellectual-property rights in the underlying artwork.
You may not reproduce, distribute, sell, commercially exploit, scrape, republish, create unauthorized derivative products from, or otherwise use protected Render-Lab content except as allowed by law or with prior written permission.
Third-party names, marks, characters, imagery, or other rights remain the property of their respective owners where applicable. Nothing on the Services grants a license to third-party intellectual property.
10. ACCEPTABLE USE
You may not use the Services to violate applicable law or another party's rights, commit or facilitate fraud, attempt unauthorized access, introduce malware, interfere with operation or security, harvest personal information without authorization, materially disrupt the Services with automated systems, circumvent reasonable technical restrictions, or infringe intellectual-property, privacy, publicity, or other legal rights.
We may restrict or terminate access when reasonably necessary to enforce these Terms, protect customers or the business, comply with law, or maintain the security of the Services.
11. THIRD-PARTY SERVICES AND SHOPIFY
The Services may rely on third-party providers for ecommerce infrastructure, payment processing, production, fulfillment, shipping, analytics, hosting, or other functions.
Render-Lab is powered in part by Shopify. Transactions for Render-Lab products are between you and Render-Lab, not Shopify.
Third-party services may have their own terms and privacy practices. We are not responsible for third-party websites or services that we do not control, except to the extent responsibility cannot legally be excluded.
12. PRIVACY
Our collection and use of personal information is governed by our Privacy Policy.
Shopify and other service providers may process information as necessary to provide checkout, payment, fraud-prevention, hosting, fulfillment, and related services.
13. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Services are provided on an "as available" basis.
We do not guarantee that the website will always be uninterrupted, error-free, or free of every harmful component.
Any warranty disclaimer in these Terms does not apply where a warranty or consumer protection cannot legally be excluded.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Render-Lab will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services or purchase of a product, including lost profits, lost revenue, or loss of data.
To the extent permitted by law, Render-Lab's aggregate liability arising from a particular order will not exceed the amount actually paid to Render-Lab for that order.
These limitations do not apply to liability that cannot legally be limited or excluded.
15. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold Render-Lab harmless from third-party claims, losses, or reasonable costs arising from your unlawful use of the Services, your infringement of another party's rights, or your material violation of these Terms.
16. GOVERNING LAW
These Terms and transactions with Render-Lab are governed by the laws of the Commonwealth of Pennsylvania and applicable federal law, without regard to conflict-of-law principles, except where mandatory consumer-protection law requires otherwise.
Any dispute that must be brought in court will be brought in a court with proper jurisdiction in Pennsylvania, unless applicable law gives you the right to bring the dispute elsewhere.
17. SEVERABILITY AND WAIVER
If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
A failure by Render-Lab to enforce a provision on one occasion does not waive the right to enforce it later.
18. CHANGES TO THESE TERMS
We may update these Terms to reflect changes to our Services, products, business practices, or legal obligations.
The current version will be posted through our storefront or checkout with an updated effective date. Changes apply prospectively unless applicable law permits otherwise.
